Francis Ferguson's Will
January 26, 1842

(In his own hand)

In the name of god amen. I Frances Ferguson of the state of alabama &
county of green being mindfull of my mortality do this 26th day of January
1842 make and declare this my last will & testament in maner and form
following: first I resign my soul into the hands of Almighty God who ga
it and my body to a decent burial at the discrestion of my Executo
worldly Estate I give and devise as follows

Article 1st, I give and bequeath to my eldest son Lewis Ferguson all my
right and interest in a certain tract of land known as the west half of the
north west quarter of section five in Township tewnty three of range one
east lying in the county of Green & that of ala. - and in the distri
lands offered for sale at Tuscaloosa.

Article 2nd, I give and divise unto my son Abraham Ferguson all my Interest
in a certain tract of land known as the east half of the of the south west
quarter of section thirty township twenty four of range one East in the
district of land offered for sale in Tuscaloosa in the county of Pickens &
State of Alabama.

Article 3, I give and bequeath to my daughter Jane Murphey and the heirs of
her body a tract of land known as the west half of the south west quart
of section twenty seven of township nine n of range eleven east in the
district of land offered for sale at Columbus in the ???????? and state of
Mississippi.

Article 4th, I give to my daughter Sarah Chamblee and to the heirs of h
body a tract of land known as the east half of the south east quarter of
section twenty eight township nine of range eleven east in the district of
lands sold at Columbus in the county of Nashoba?? & state of Mississippi.

Art. 5th, I give and divide to my daughter Malena Ferguson and the heirs of
her body a tract of land known as the East half of the south west quart
of section twenty seven in township nine of range eleven east lying in the
county of Nashoba & state of Mississippi in the district of lands so
Columbus -

Art 6th, I give and devise to my daughter Mary Ferguson & to the hei
her body a tract of land known as the west half of the south east quart
of section twenty seven township nine n of range eleven east in the district
of lands sold at Columbus in the county of Nashoba and state of Mississippi.

Art 7th, I give and devise to my daughter Nancy Ferguson & to the heirs of
her body a tract of land known as the east half of the south east quart
of section twenty seven in township nine n of range eleven east in the
district of lands sold at Columbus in the county of Nashoba and state state
of Mississippi.

Art 8, I give and devise to my duaghter Elizabeth Ferguson and to the heirs
of her body East half of the north East quarter of section on of Townsh
ten n of Reange ten East in the District of lands sold at Columbus in t
county of Nashoba and state of Misssissippi.

Art 9, I give and devise to my daughter Hannah Ferguson and the heirs of
her body the west half of the north East quarter of section one of Township
ten n of Range ten East in the district of lands sold at Columbus in the
county of Nashoba and state of Mississippi.

Art 10, I give and devise to my daughter Rosealine Ferguson & the heirs of
her body the north west quarter of section one of Township ten n of Ran
ten East in the district of lands sold at Columbus in the county of Nashoba
and state of Mississippi.

Art 11th, I give and devise to my three youngest sons (to wit, Francis,
John L. and James Edward) all the tract of land whereon I now live with the
exception of Eighty acres of woodland south of my farm and that Franc
John L, when of age shall receive their equal portion of said land and
James Edward when of age shall also receive his equal part of the above
named land. And further my will is that my four youngest children (to wit)
Francis, John L, James Edward & Rosseline shall be educated out of the
proceeds of my estate so as to give them a common English education.

Art. 12th, I give and devise to my beloved wife Hannah Eighty acres of land
south of my plantation and the East half of the north East quarter of
section two of township ten n of range ten eEast in the district of lan
sold at Columbus in the county of Nashoba & state of Mississippi. I al
devise that if the above named eighty acres of land South of my farm should
be sold before it comes into the possession of my beloved wife that she
shall have the proceeds of such sale to her own benefit forever.
I also bequeath to my beloved wife my negro man Narry (or Harry) and all my
stock of horses & hogs, sheep and cattle also the stock of cattle in the
state of Mississippi in the care of Lewis Ferguson and all my household and
kitchen furniture and every article of value also my crop farming utinsils
waggon and every thing of value not otherwise mentioned and further my
will is that my children that is now with me (to wit) Melina, Mary. Nancy,
Elizabeth., Hannah, Francis, John L, James Edward and Rosseline shall as
they marry receive such portions out of the above named personal proper
or the proceeds of t6h same so as to make them as near equal with those
married heretofore as the Estate will justify agreeable to the oppinion of
my executors-in witness whereof I have hereunto set my hand and seal the
day and year first above written and last I appoint Hannah my wife
executrix and Lewis & Abraham Ferguson my sons my executors and my sons
Francis, John L & James Edward assistant executors as they come of age
signed sealed published and declared by the said testator to to be his last
will and testament in presence of us

To the Honorable the Judge of the County Court of Green County, Ala.

Sir it appears that my farther, Francis Ferguson in his will made me one of
the executors of his will, it is so far and inconvenient that I can't
attend to it and refuse to act as such.

February the 29th 1844.

To the Honorable Judge of the county court of Green County, Alabama,
Having been appointed executor by my father of his will, with Mother and
two other brothers, owing to the distance I live from them, and having the
utmost confidence in those appointed and the court to transact the will of
my Father, I resign my appointment as executor of the last will and
testament of Francis Ferguson, Sr., recommending to the court and my
friends the cheapest plan they can fall on to execute the will.
